Along with the project scope those documents are as follows: all legal documents, price lists, and promotional materials which were submitted for RERA approval.
The Real Estate Regulatory Act was structured taking into account the issues of deception and the existing problems in the real estate sector which are quite common since 2016. The Act prevents buyers and investors from being misled through an offer that is not true, such as advertisements as well as purchasing off plan apartments. Builders are required to apply to the RERA authority to obtain approval to develop their project with an aim of marketing and selling it to investors. Builders will be held responsible for any financial fraud related to the project in compliance with the RERA rule and above all the builders must be accountable in all their business dealings. Main features and importance of RERA.
-
- Regulatory Assurance: A project that can be endorsed with the RERA certification means it is completed depending on the set guidelines and procedures of the authority. It provides the investors and purchasers assurance that they will put their money in a soon to be developing residential project.
- Timely Completion: RERA guarantees a project will meet its deadlines. Every project has a time frame in which it depends on, and within that time frame, it is the responsibility of the builders to hand over the fully developed homes to the investors. If they have no show then it is only fair that the investors and home owners are compensated.
- Builder Liability: All projects covered by RERA tend to provide better living standards as a result of the use of better quality raw materials during construction. If they provide poor quality services and construct sub standard homes, the investors will take them to court for compensation. For a certain period of time, any remedy of the building construction resided on the builder at fault.
- Escrow Account:Part of the project fund should be set aside into an escrow account by the builder. This helps to avert the risk of relocation of the funds into other external businesses.
In order to advertise their project and draw public funding into their real estate activities, every real estate activity has to be registered under RERA. The RERA Authorities do not allow misuse of public investment funds during construction and ensure that fraud is not witnessed.
